My national visa application got rejected. What can I do?
Upon receiving an official letter rejecting a visa application, the applicant has two possibilities:
1. The applicant may apply again for a visa at any time.
2. The applicant may file a lawsuit against the rejection.
The application will then be re-assessed by the administrative court in Berlin. Please note: Starting from 01.01.2024, the legal remedy of the “Remonstration” is no longer available at the German visa sections in India. Only rejection letters dated 31.12.2023 or earlier allow the applicant to file a “Remonstration”.
Why did I receive a rejection of my visa application?
Please be aware of the fact that a reason for refusal has already been given in the rejection letter. The visa section will not give any additional explanations regarding the same via e-mail.
Please explain in your lawsuit in detail why the rejection is unfounded from your view. If necessary, you can add further documents, which have not yet been submitted with the application.
Information about how to file a lawsuit
The applicant has the possibility to file a suit with the administrative court in Berlin (Verwaltungsgericht Berlin). The court will investigate whether the applicant has a claim for being granted a visa, and whether the refusal violates the applicants legal rights. The deadline for filing a lawsuit is one (1) month after receiving the refusal.
Kindly note: The visa section is not allowed to give legal advice. For information about visa-relevant issues, please refer to the public information here or seek individual legal advice.
